These terms and conditions govern the use of the Alkham Agricultural Services website and the provision of services by us. Alkham Agricultural Services is an agricultural contracting business based in Kent, England. Quotes and Estimates
All quotes provided by Alkham Agricultural Services are free of charge and given without obligation. A written quote is valid for 30 days from the date of issue unless otherwise stated in writing. We reserve the right to revise or withdraw a quote if the scope of work changes, if additional information comes to light, or if site conditions are found to differ materially from those described or observed at the time of quotation. Acceptance of a quote constitutes agreement to these terms and conditions.
Commencement and Carrying Out of Work
Work will only commence following agreement of the scope, price, and any relevant access or site requirements. The customer is responsible for ensuring that we have safe and adequate access to the site at the agreed time, and that all necessary permissions from landowners, tenants, local authorities, or other relevant parties are in place prior to the start of work. Any delays caused by failure to provide adequate access or permissions may result in additional charges. We reserve the right to refuse, suspend, or cease work at any time if we reasonably consider site conditions to be unsafe or if instructions require us to act outside of agreed or lawful parameters.
Payment Terms
Payment terms will be agreed and confirmed in writing prior to the commencement of work. Unless otherwise agreed, invoices are due for payment within 30 days of the invoice date. We reserve the right to charge statutory interest on overdue payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, at a rate of 8% above the Bank of England base rate. We also reserve the right to recover reasonable debt recovery costs on any overdue invoices. Ownership of any materials supplied by us remains with Alkham Agricultural Services until payment has been received in full.
Cancellation and Variation
If you wish to cancel or vary an agreed job, please notify us as soon as possible. Where work has already commenced or materials have been ordered, we reserve the right to charge for work completed to date and any costs reasonably incurred as a result of the cancellation or variation. Any agreed variations to the scope of work must be confirmed in writing and may result in a revised quote.
Insurance
Alkham Agricultural Services holds full public liability insurance. Details of our insurance cover are available on request. The customer is responsible for ensuring that their own land, property, livestock, and assets are adequately insured. We recommend that all parties satisfy themselves as to the adequacy of their own insurance arrangements prior to work commencing.
Liability
We take every reasonable care in carrying out our work. Our total liability to you in connection with any contract for the provision of services shall not exceed the value of that contract. We are not liable for any indirect, consequential, or economic loss, loss of profits, loss of opportunity, or any damage arising from circumstances beyond our reasonable control including but not limited to adverse weather, ground conditions unforeseen at the time of quotation, or third party actions. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
